We, Kirkgate Engineering Ltd (“Kirkgate”) are committed to protecting your personal data. This privacy notice explains how we, Kirkgate, handle the personal data which we hold including the personal data which we collect when you use our website, www.kirkgate-eng.co.uk or otherwise when we collect personal data from you such as if you contact us by email, telephone, via our website contact form or in writing.

It also explains your privacy rights and how the law protects you including how we comply with the General Data Protection Regulation (“GDPR”) and other related legislation which relates to the use of personal data.

Additional information may be provided on particular pages of the websites for example, on any specific pages where we collect personal data and you should also refer to those.

Data Controller

Kirkgate Engineering Ltd is the date controller and is responsible for the use of your personal data. Our full details are set out at the bottom of this privacy notice.

  1. Your obligations

    It is important that the personal data we hold about you is accurate and current. Please keep us informed if your personal data changes during your relationship with us.

    This privacy notice aims to give you information on how Kirkgate collects and processes your personal data through your use of our website, including when you:

    • place orders;
    • create an account with Kirkgate; or
    • contact us with an enquiry by email, telephone or by filling out our website contact form.

    • site/delivery address;
    • contact telephone numbers (including mobile);

    • financial data, such as bank account details when you place an order with us.

  4. How we use your personal data:

    • to open and administer the account which you or the organisation you represent has with us. This will be necessary for the performance of the contract that will be in place between us. The use of this data is also in our legitimate interest in ensuring that goods and services we provide are managed, such as to recover debts due to us.
    • to aid the manufacture and delivery of our goods and to provide our goods and services to you as per your purchase order, including for example, to contact you or deal with invoicing as well as for our internal record keeping or, where the organisation you represent is one of our suppliers, to correspond with you about goods and/or services we have ordered from you and to make necessary arrangements with you, as well as to carry out any audits required. This will be necessary for the performance of the contract that will be in place between us. The use of this data is also in our legitimate interests in ensuring that the goods and services we provide are managed;
    • to deal with new enquiries and contacts. This will be necessary for our legitimate interests in the operation of our business in order to be able to respond to and deal with new enquiries, for example, to assess your CV for any job vacancies that we may have available.
    • to ensure our third-party providers can perform their obligations to us, for example, we may provide certain details to our delivery service provider so that your goods can be delivered. This will be necessary for our legitimate interest in ensuring that our third-party providers perform their services for us.
    • to gather your feedback on our services. This will be necessary for our legitimate interests in seeking to improve the quality of our services.
    • to provide you with marketing communications such as our company newsletters, or any other information we think you may find interesting. This will be necessary for our legitimate interests in developing, marketing and promoting our goods and services; and
    • to comply with legal or regulatory obligations, regarding any legal proceedings or prospective legal proceedings, in order to establish, exercise or defend our legal rights and/or where we may otherwise do so in accordance with applicable data protection legislation.

    We only use your personal data where the law allows us to.

  5. Retention of your data:

    We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for including for the purpose of satisfying any legal, accounting or reporting requirements.

    As required by HMRC, we have to keep basic information about our customers including your contact details, such as your address and your financial details, such as your bank account details, for six years after they cease being customers for tax purposes.

    We may keep purchase orders and associated drawings for as long as necessary to fulfil the purposes we collected it for and to satisfy repeat orders in the future, and these will thereafter be archived. While we do not intentionally keep personal data for archived purposes, it is likely that some contact details will be maintained, for example, where we would like to keep drawings of previous projects in respect of satisfying repeat orders, such drawings might incidentally include your personal details, such as your name and email address.

  6. How we may share your personal data:

    Data collected will not be shared with 3rd parties unless they are part of the order process, i.e. subcontractor to ourselves or delivery services, or for our internal administrative purposes (for example, we may share personal data with our IT provider so that they can perform their obligations to us).

    We will never pass on your details to another company other than stated above, without your consent.

    We will never sell on personal data to a third party.

    When we need to comply with legal or regulatory obligations, generally, we do not rely on consent as a legal basis for processing your personal data.

    We do not transfer your personal data outside the European Economic Area.

    • request access to your personal data;
    • request correction of your personal data;
    • request erasure of your personal data;
    • request restriction of processing your personal data;
    • withdraw your consent at any time;
    • request transfer of your personal data;

    Kirkgate takes all reasonable steps to protect your personal data from misuse, interference and loss, as well as unauthorised access, modification or disclosure. The ways we do this include:

    • limiting physical access to our premises and to your personal data to those employees, agents, contractors and other third parties who have business to know it;
    • having in place technical and organisational measures to ensure access is limited within;
    • ensuring we have appropriate security safeguards to keep personal data secure; and
    • when required ensuring documents are destroyed securely.

    This website may include links to third-party websites, such as our Twitter social media page. Clicking on those links may allow third parties to collect or share data about you. We do not control these third-party websites and are not responsible for their privacy policies. You should read any policies and other statements on such websites carefully.
